This Privacy Policy ("Policy") describes how Southland Ventures, Inc. d/b/a AcutisLOS ("we," "us," or "our") collects, uses, and shares information through our website, mobile applications, and our Loan Origination System platform (collectively, the "Service").

This Policy applies to all parties using the Service, including mortgage brokers, lenders, processors, and individual loan applicants. While we provide the platform to facilitate the mortgage lending experience, we are not a lender or broker. All loan decisions and evaluations of creditworthiness are made solely by your lender or broker.

2. Information We Collect

We collect information in several ways: when you provide it directly, when third parties (like credit bureaus) provide it, and automatically through your use of the Service.

  • Information You Provide: Name, Social Security Number, email, phone number, mailing address, date of birth, employment history, tax returns, and financial information related to income and assets.
  • Information from Third Parties: We may collect credit history from credit bureaus, identity verification data, and information from your employer or financial institutions as directed by your lender or broker.
  • Automatically Collected Information: IP address, browser type, operating system, device identifiers, and usage data (pages viewed and time spent on the platform).
  • Cookies: We use cookies to maintain your session, personalize preferences, and analyze platform preferences.

3. How We Use Your Information

We use the information collected to:

  • Process and underwrite loan applications.
  • Verify the accuracy of information (address, employer, credit history).
  • Facilitate communication between applicants, brokers, and lenders.
  • Provide customer support and technical notices.
  • Detect and prevent fraudulent or illegal activity.
  • Comply with legal and regulatory obligations, including the Gramm-Leach-Bliley Act (GLBA).

4. Sharing of Information

We may share your information with:

  • Authorized Users: Your mortgage broker, lender, or processor involved in your transaction.

We employ industry-standard encryption technology for data both in transit and at rest. We retain personal information for as long as necessary to fulfill the purposes for which it was collected, typically ranging from 3 to 7 years to comply with federal and state mortgage record-keeping laws.

California Privacy Notice

This California Privacy Notice supplements our Privacy Policy and applies solely to California residents ("consumers") in accordance with the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA).

Note that much of the information collected by AcutisLOS is collected for the purpose of providing financial services and is therefore governed by the Gramm-Leach-Bliley Act (GLBA) or the California Financial Information Privacy Act (FIPA). Such information is exempt from CCPA/CPRA disclosure and opt-out requirements.

2. Categories of Personal Information Collected

In the preceding 12 months, we may have collected the following categories of personal information:

  • Identifiers: Name, alias, IP address, email, SSN, Driver's License number.
  • Customer Records: Financial information, employment history, and insurance details.
  • Protected Classifications: Age, race, gender, or marital status (collected only as required for government monitoring/compliance).

  • Geolocation Data: Physical location of your device.
  • Sensitive Personal Information: SSN, account log-in credentials, and precise geolocation.

  • Right to Know: The right to request the categories and specific pieces of personal information we have collected about you.
  • Right to Delete: The right to request the deletion of your personal information (subject to legal retention requirements).
  • Right to Correct: The right to request the correction of inaccurate personal information.
